Terminating a regional center


The U.S. Citizenship and Immigration Services (USCIS) may decide to put an end to the regional center of an EB-5 visa holder if the holder fails to properly submit required papers or if the business no longer contributes to the U.S. economy.

Regional center investors who have received a “Notice of Intent to Terminate” (NOIT) are given 30 days to respond to and contest the notice. The USCIS will then review the regional centers that issue a response to determine if they will be allowed to continue their business or not. Regional centers that have been terminated from the EB-5 program may file an appeal, motion for reconsideration, or motion to reopen. Regional centers should note that a NOIT and “Notice of Termination” are two different entities. Regional centers who have received a NOIT may continue to operate while undergoing the termination process, but a terminated facility may not.
