Common Questions
Frequently Asked Questions
What is the minimum investment for an EB-5 green card?
The minimum is $800,000 if investing in a Targeted Employment Area (TEA) — typically rural or high-unemployment zones. The standard minimum is $1,050,000 for all other areas. Investments through USCIS-designated Regional Centers are the most common structure.
How long does the EB-5 process take?
Typical timelines are 18–36 months from filing the I-526E petition to conditional green card approval, depending on your country of birth and current USCIS processing. An additional 2 years are required to remove conditions through the I-829 petition.
What evidence do I need for an EB-1A petition?
You need to satisfy at least 3 of 10 USCIS criteria: awards, membership in elite associations, published media coverage, judging others’ work, original contributions, scholarly articles, exhibition of artistic work, leading roles in distinguished organizations, high salary relative to peers, or commercial success. A final merits determination also applies.
Can my family get green cards too?
Yes. All permanent residency categories cover the principal applicant’s spouse and unmarried children under 21. They receive their own green cards as derivative beneficiaries and enjoy the same rights as the principal applicant.
What is the difference between EB-1A and EB-2 NIW?
EB-1A requires demonstrating you are at the very top of your field — a genuinely elite standard. EB-2 NIW requires an advanced degree or exceptional ability and that your work benefits U.S. national interests — a broader, more accessible standard. Both are self-petition and require no employer. Many clients are eligible for both.
Can I self-petition without a green card sponsor?
Yes. EB-5, EB-1A, and EB-2 NIW are all self-petition categories — no U.S. employer sponsor is required. This gives you full control over your own immigration timeline and independence from employment conditions.
