What is an EB-5 Visa?

The EB-5 visa is an increasingly popular immigration option that allows foreign nationals to earn permanent residency in the United States by investing in U.S.-based businesses. Generally speaking, it is one of the fastest routes to acquire permanent residency (and citizenship) without the backlogs and limitations that are characteristic for other visa categories.

Investors must contribute capital to a venture that generates at least ten full-time positions for American workers. The amount required depends on the location: projects in underserved areas, such as rural towns or regions with high unemployment, generally need $800,000, while investments in urban or standard areas require $1,050,000. Approved investors, along with their spouse and children under 21, initially receive conditional residency, which can later be converted into a permanent green card. After 5 years of residency, the applicant and family may apply for citizenship.

The EB-5 visa provides a direct path to a green card without the need for other qualifications such as employment experience, evidence of extraordinary achievements or other requirements of other visa categories. Applicants and their families are free to live anywhere in the U.S. without being tied to an employer or other limitations. Moreover, the visa set asides allow applicants, for example, from China and India to avoid the long lines that are present for other green card categories. All these features make it a practical route for those seeking both residency and a meaningful economic contribution in America.

Benefits of the EB-5 Visa Program

#2 Multiple Investment Opportunities Throughout the U.S.

Obtaining an EB-5 visa opens the door to multiple investment opportunities in the US, including:

  • Passive investment opportunity for those who want to become a member of a multi-million dollar regional center project;
  • Active investment for a business in any U.S. state;
  • Return on investment in as little as 5 years, on average;
  • For those investing in regional project centers, dividends will be claimed throughout the term investment; and
  • Project success through the participation of reliable banks and other investors

#3 No Need to Operate Your Own Business in the U.S.

The EB-5 visa allows an investor to passively invest in a project to acquire residency without the hassles and time requirements of running your own business in the United States. The regional center oversees the project’s construction and ensures compliance with EB-5 requirements.

Who Qualifies For an EB-5 Visa?

The EB-5 visa is designed for foreign nationals who wish to combine investment with the opportunity to live permanently in the United States. While the technical requirements are handled elsewhere, eligibility from a practical perspective depends on the type of investor and their goals.

1. Ideal Candidate Profile

  • Individuals seeking a path to U.S. permanent residency for themselves and their immediate family.
  • Entrepreneurs interested in investing in their own business in the U.S. which will qualify for the EB-5 program.
  • Passive investors interested in participating through large development projects sponsored by regional centers.

2. Types of Investors

  • Direct investors: Prefer hands-on management of their own enterprise.
  • Regional center investors: Favor passive participation in professionally managed projects with shared risk.Historically speaking, approximately 97% of EB-5 investors participate through regional center projects rather than in their own proprietary businesses.

3. Program History and Benefits

Established in 1990 to stimulate U.S. economic growth and job creation. Modern reforms, such as the EB-5 Reform and Integrity Act of 2022, introduced stronger oversight and dedicated visa set-asides for rural and high-unemployment areas, creating new opportunities—and in some cases more favorable processing—for investors who choose qualifying projects in these categories.

4. Key Considerations

Applicants must have a verifiable source of funds and a clear investment plan. Strategic legal guidance helps investors navigate the process, maximize benefits, and protect their immigration status.

Regional Centers for EB-5 Investor Visa

A Regional Center is a government-licensed commercial structure that brings together stakeholders: developers, investors, banks, and other management organizations in order to finance investment projects under the EB-5 program to develop the U.S. economy.

Participation in the program by investing in regional center projects is oftentimes a more popular option. In fact, approximately 97% of all EB-5 investors invest in a regional center project. Regional center investments are more popular since they handle all compliance matters, carefully vet the developers and projects, and have a number of stakeholders in each project who have a vested interest in the successful implementation of the project. They carefully monitor the project at every stage of its implementation, thereby preventing any possibly unfavorable scenarios.

Frequently Asked Questions (FAQ)

HOW LONG DOES IT TAKE TO COMPLETE THE EB-5 VISA PROCESS?

The timeline for an EB-5 visa depends on several variables, including the applicant’s home country, the complexity of the investment, and whether the investment is through a regional center or direct enterprise. Typically, the approval process can take anywhere from 12 months to several years. Rural projects are generally being reviewed within 12 months (sometimes even faster), while urban projects generally require 2+ years to receive a decision. In addition, after the approval from USCIS, time must also be allocated for the interview process at the consulate or the adjustment of status process (if the applicant is already in the U.S.). These post-approval procedures can generally add 8-12 months to the timeline before receiving the conditional green card.

WHAT IS THE MINIMUM INVESTMENT REQUIRED FOR AN EB-5 VISA?

The required investment amount varies by project location:

  • $800,000 – for investments in targeted employment areas such as rural regions, high-unemployment areas, or qualifying infrastructure projects
  • $1,050,000 – for investments in all other locations

All funds must remain “at risk” and must be fully documented to prove a lawful source and path. Proper structuring and documentation are critical to meeting EB-5 program standards and avoiding issues during petition review.

CAN I WORK IN THE U.S. WHILE WAITING FOR EB-5 APPROVAL?

Filing an EB-5 petition does not automatically grant work authorization. However, individuals already in the United States on another valid status may, in some situations, apply for temporary work authorization or continue working under their current visa category. An experienced immigration attorney can help identify options to maintain lawful presence and, where possible, acquire work authorization and advanced parole to leave the U.S. while the EB-5 application is pending.

HOW DO I CHOOSE THE BEST EB-5 IMMIGRATION ATTORNEY?

Selecting the right EB-5 lawyer involves evaluating:

  • Experience with both direct and regional center investments: A qualified attorney can give recommendations of reliable regional centers as well as provide guidance as to whether a direct or regional center option would be best.
  • A proven track record of handling complex source-of-funds issues: Given the long investment cycles and timelines in the EB-5 program, an attorney needs a minimum of 5-7 years of experience to have merely a basic grounding in EB-5. If you’d like a specialist with solid experience, then 10 years should be the minimum threshold.
  • Familiarity with the latest EB-5 reforms and compliance requirements: the EB-5 program has a myriad of nuances that set it apart from all other visa programs.
  • Ability to explain risks and options clearly, in a way that fits your goals: EB-5 applications require a lot of interaction between the attorney and client to ensure a properly prepared petition. If that interaction is lacking, the results of the petition might disappoint you.

AmLaw Group has been handling EB-5 cases for over 20 years–a track record that a very limited number of law firms can attest to. We treat all of our clients with personal attention that is lacking at larger firms while ensuring the positive results all our clients expect.
