Immigration Lawyers
An immigration lawyer is a lawyer who specializes in topics connected to immigrants in the U.S., such as visas, green cards, deportations, and other immigration-related legal concerns. An immigration lawyer can assist you with a variety of tasks, including double-checking forms you’ve already completed, filling your papers for you, and defending you in an appeal or deportation case.
When do you need an Immigration Lawyer?
If you find yourself in the following situations, you should seek the advice of an immigration lawyer:
- You’re not sure if you’re eligible for a green card or any other immigration benefit;
- You’re requesting discretionary remedy, such as asylum or a waiver, which entails convincing the immigration authorities to make exception or provide you with benefits that another applicant in your situation would not receive;
- You received government aid while in the United States, or you’re worried that you may be inadmissible for any reason;
- You’re having trouble getting a green card, citizenship, or other immigration benefits from the United States Citizenship and Immigration Services; perhaps you’ve been requested to provide extra evidence;
- You require immediate assistance with an immigration issue;
- You’ve been informed that deportation or removal proceedings against you have begun;
- You were deported from the United States and want to come back;
- You have already had an immigration petition refused or rejected;
- You were convicted of or committed a criminal act and are attempting to enter the United States or defend yourself from deportation;
- You’ve checked the application procedure and discovered that the number of paperwork and documentation you’ll need to complete on your own is either too complex or time-consuming;
- You’re applying for a visa based on investment;
- You want to migrate to the United States to work for an American employer. Still, it hasn’t helped you with any immigration process;
These are just some of the instances when do you need an immigration lawyer to provide aid for your legal immigration concern. There are plenty of others!
Now we know when you need to call an Immigration Lawyer, but when do we need not to?
Not every immigration concerns necessitate the assistance of an immigration lawyer. For example, if you simply want to travel around the U.S. for a vacation and are confident that you’ll be ready to come back in 90 days, you may not need a visa at all and instead travel under the Visa Waiver Program if you are from one of the nations on the list.
However, immigration law in the United States is quite complicated. Hiring an attorney can save you time, frustration, and even money in many circumstances (if you have to repeat an application that was completed improperly the very first time, or if you have to defend yourselves in deportation proceedings once an application has gone gravely wrong).
Choosing the Right Lawyer for your Immigration Case
A qualified immigration lawyer can significantly impact your chances of success. Many are dedicated experts who sincerely wish to assist. After all, they could be making far more money in another area of law. They are also dealing with a bureaucracy that is prone to delays.
A lousy immigration lawyer, on the other hand, can charge you extra, fail to provide the services promised, and/or permanently harm your case. Whether you’re looking to file an application for a visa or green card, escape deportation, or apply for other types of immigration benefits, make sure you hire the correct counsel. Here are some suggestions for avoiding shady practitioners.
Lawyers who approach you at USCIS or other immigration offices should be avoided.
A few “high-volume, low-value” immigration lawyers stalk the halls of immigration offices, looking for work. Besides, any decent immigration attorney will be far too busy practicing immigration policies and working for their clients to waste time in this manner.
Check to see that you’re working with a real attorney, not a “Visa Consultant,” “Notario,” or “Petition Preparer”
Would you ask a friend to repair your heart valve or your doctor to complete your tax paperwork? Perhaps not. You should only entrust your immigration concerns to an actual practicing lawyer for the same reasons.
Unfortunately, many non-lawyers, including some well-intentioned individuals, claim to be competent in assisting foreign nationals who require assistance with the immigration process. They frequently provide little more than a typing service. In the worst-case scenario, they may simply take your cash and run, or they may fill out your documents incorrectly and dangerously without informing you.
Examine the lawyer’s background and reputation
You can probably learn a lot about your lawyer from the internet: whether he or she is a member of a state bar association (which is required) and the American Immigration Lawyers’ Association, or AILA (a professional organization which most of the best lawyers join); if he or she has received positive reviews on websites; if the lawyer has published professional articles for publication; etc.
You can avoid a personal meeting if the only evaluations you find show the lawyer being arrested or disbarred.
Avoid lawyers who provide unethical advice or offer illegal services
Any immigration attorney who proposes that you fake a petition, bribe an immigration authority, or sell a bogus green card should be avoided.
Those instances occur in reality. If you are found participating in such a scam, you will likely experience far harsher consequences than the attorney. “But he informed me that getting this green card stamp was the shortest way to work in the United States!” is unlikely to get you anywhere and will leave a lasting mark on your immigration record, making you ineligible for future visas or green cards (inadmissible).
Beware of false promises
Even the most skilled lawyers cannot guarantee success. An immigration court, the Department of Homeland Security, and/or USCIS are ultimately responsible for the outcome of your case. Any lawyer who claims to have a 100% success rate and promises you a specific result should be scrutinized more closely.
Compare legal advice from multiple attorneys.
While most reputable immigration attorneys will be quite occupied, you must be able to speak with them and their office employees to get a feel of their dedication to customers as well as their overall manner and sense of honesty.
Speaking with many attorneys can provide you with references to compare before deciding who will represent you. It will allow you to have a sense of their character and work philosophy in order to figure out who would be a good match for you. Getting a second opinion may disclose that the first lawyer didn’t completely comprehend your situation or the law or attempted to take your money to accomplish something impossible or immoral. It may also confirm that you are on the correct track.
Expectations for the First Meeting with the Immigration Attorney
- Bring any personal documents relating to your immigration position, like your passport, visa(s), I-94, marriage certificate, criminal conviction records, and any immigration notices.
- The lawyer will likely ask you a series of questions and write notes before advising you on how to proceed and whether additional documents need to be provided or applied.
- Many immigration lawyers charge a flat fee for common cases, such as assisting with a marriage-based green card application. However, the attorney will probably bill you by the hour for less predictable legal assistance, such as representation in an immigration court proceeding (which might turn into numerous hearings).
- The consultation is your opportunity to tell the lawyer about your situation and ask questions. Provide as much information to the attorney as possible to avoid strategy errors or unwanted surprises later. Your attorney is obligated to keep your information private. However, keep in mind that an attorney’s job does not entail lying on behalf of the client.
- If someone tells an attorney, for example, “I need help drafting paperwork for my false, green-card marriage,” the lawyer (if he or she is credible; others are not) would have to tell the client to seek help elsewhere.
We Can Help you with your Immigration Concerns!
The highest immigration advantage granted by the U.S. government is citizenship. Being a citizen of the United States allows you to stay in the country and gives you access to a variety of benefits, including the ability to vote, defend the country, and bring family members to live with you.
Most immigration lawyers are just concerned with the procedure. They feel their role is to simply assist you with the visa or green card application procedure. At AmLaw Group, we focus on the process, but it’s not our final goal. Our work isn’t complete until you receive your green card or visa and realize your ambition of residing in the United States.
